Lindsay Lohan Caught Drinking, But Lawyer Says She's on Track to Sobriety

The movie beauty was spotted taking a swig from a champagne bottle at a New Year's Eve party in Capri, Italy.

Apparently tempted to have a taste on the sparkling wine despite her recent rehabilitation, Lindsay Lohan was captured in a video posted on TMZ.com taking a swig from champagne bottle at a party held on New Year's Eve (Dec. 31, 2007) in Italy.

The "Mean Girls" star was in the country to receive an honor for her film work at the Capri Film Festival on Sunday, December 30, 2007 and went on to celebrate the coming of 2008 in the City of Capri.

In response to the video, Lohan's lawyer, however, insisted that the actress is now "back on track" with her sobriety though did admit that she has relapsed in her struggle to stay sober.

"After being handed a champagne bottle on New Year's Eve and drinking from it, fortunately Lindsay immediately stopped herself, called her sponsor and got back on track," the lawyer, Blair Berk, claimed. "There is no magic cure here. The most unfortunate part of this is that Lindsay has to share her 'one day at a time' with the entire world."

Lohan was found to attend Alcoholics Anonymous meetings in late 2006 before checking herself into Los Angeles' Wonderland Center rehabilitation facility by early 2007, saying "I have made a proactive decision to take care of my personal health." Going out a month later, she was back into rehab twice at the Promises treatment center in Malibu and Cirque Lodge rehab facility in Sundance, Utah, where she completed a 63-day stay up to October 2007.
