The R&B star is suing former friend Michael Bourne and his recording company King Music Group, Inc. for breach of contract, fraud, and negligent misrepresentation.
Believing himself to be duped into signing a deal, R&B singer Ginuwine has launched a legal battle against record label King Music Group, Inc., alleging the company for breach of contract, fraud, and negligent misrepresentation.
The "Pony" hit-maker, real name Elgin Baylor Lumpkin, claims he initially inked a $1.75 million deal to record an album with King Music, owned by former friend Michael Bourne, including a $500,000 advance. Following the pact, however, he never received any payment and later even found out there is no corporate record suggesting the label actually exists.
Ginuwine in fact previously sued the company over the same case in mid-2007, but the two finally managed to reach a settlement out of court. Terms of the agreement, however, was never fulfilled by the label, prompting the star to launch back the lawsuit this year. The breaches, he states, have resulted in significant damages and numerous lost professional opportunities for him, as well as his inability to record new material.
"It is our belief that Mr. Bourne never intended to follow through with his and King Music Group's obligations under the Settlement Agreement," Ginuwine's attorney Brandon J. Witkow said. "Mr. Bourne has continuously misrepresented his intent and ability to comply with his promises."
