Police affidavit released on Monday, December 28 provides the actress' statement that the 'Two and a Half Men' star had pinned her on a bed and threatened to kill her on Christmas Day.
Brooke Mueller has given further details on the domestic violence allegedly done by his actor husband
Charlie Sheen on Christmas Day. According to police affidavit released on Monday, December 28, 44-year-old Charlie pinned his wife on a bed and put a knife to her throat when she asked him for a divorce.
At the time, the "Two and a Half Men" star even threatened to kill his wife if she told anyone about his bad behavior. Based on the affidavit, Sheen told his wife during their fight, "You better be in fear. If you tell anybody, I'll kill you. Your mother's money means nothing, I have ex-police I can hire who know how to get the job done and they won't leave any trace."
Upon learning that herself was in danger, shaky and tearful Mueller called 911 for help. In , she stated, "My husband had me with a knife. I was scared for my life and he threatened me." She continued saying, "I have people here. My family is here, but if I don't file this right now ... he's in the other room. He is with somebody but he's trying to leave."
Soon after Mueller made the call, officers headed to her and Sheen's home in Aspen, Colorado. Officer Rick Magnuson said he didn't find "any obvious injuries" on her body when he met her in the kitchen. Rick later took Sheen, who initially waited upstairs, to the basement to talk. During the two men's conversation, the actor admitted that he and his wife, who got married in May 2008, had marital problems lately and revealed that Mueller "abuses alcohol".

The Big Bounce" star said he began arguing with 32-year-old actress on December 25 at 3:30 A.M. because she was jealous when he "shared a song for his daughter whom he fathered with another woman." According to the affidavit, Sheen stated that during the heated argument both of them yelled and slapped each other on the arms. He denied pushing or striking her, but he did admit that he took her eyeglasses and broke them in front of her.
Following the alleged domestic violence incident, Sheen faces felony charges and may be sentenced up to 8 years behind bars if convicted. However, the charges won't be laid before his appearance in court on February 8, 2010. Chief deputy district attorney Arnold Mordkin told RadarOnline, "I don't plan on charging or doing anything with Mr Sheen until close to his first court date on February 8th. Mr Sheen is required to attend the first court hearing on February 8th."
Additionally, criminal defence lawyer Lauren R. Maytin, who isn't working on the case, said, "There's a whole range of options with this situation. In order for second-degree assault to be charged, there has to be serious bodily injury." He explained further, "He's looking at two to eight years in prison if he's charged with the class four felony of second-degree assault and because it's a crime of violence he'll be required to serve at least the midpoint of that, being five years, as well as three years of mandatory parole."
