Brooke Mueller is planning to divorce the actor and has already met with divorce lawyer in the weeks prior to his attack.
Of her reason on having the consultation with the attorney, a source told the site, "She's miserable in the marriage and so is he." The source further claimed that Sheen attacked Mueller after she told him she was going to divorce him. Mueller herself actually has distanced herself from the actor by rented the house in Aspen for three months, but the actor flew in to spend Christmas with his two baby sons.
Soon after reports of Sheen getting arrested for domestic violence, his representative has come out with statement that the couple will not have a divorce. However, a source close to Mueller said if the actor wants her to stand by him, he'll have to pay. "They have a prenuptial agreement," the source pointed out. "She already decided to divorce him. Now he desperately needs her not to drive the stake through his heart and a lot of money is at stake. You do the math."
Charlie Sheen was placed under arrest on Friday, December 25 after a call to 911 was made by Brooke Mueller, who reportedly claimed that she was choked during a heated argument at their home in Aspen, Colorado. Later in the evening, Sheen was released from Pitkin County Jail after posting an $8,500 bond, but the 44-year-old is still expected to appear in court on February 8, 2010 at 10.30 A.M.

Denise Richards, in the meantime, has promised to spill the beans about her life, which could include details in her marriage life with the actor. Taking it to her Twitter account on Tuesday, December 29, she wrote, "sorry had to vent s*** pisses me off sometimes..one day..I will spill my guts about EVERYTHING".
Prior to the tweet, she blasted the criticism accusing her of arranging a photo op with paparazzi. "for all the negative nellies out there, I DID not have a f..ing photo op with my kids at a park when there is drama u get followed more," she ranted. "I genuinely love to be with my girls and don't have a nanny raising them. They are my #1 priority and always will be."
