'The injuries Brooke [Mueller] got are not the type that would usually warrant someone going to state prison,' a criminal defense attorney says in response to felony charges report for the TV actor.

Charlie Sheen is likely to avoid being put behind bars. To Hollywood Life, criminal defense attorney Steve Cron stated, "The injuries Brooke got are not the type that would usually warrant someone going to state prison."
"A state prison sentence rarely happens [in a case like this] where there is not an extreme injury," Cron further explained. The lawman, in addition, pointed out that Brooke's request for Charlie's restraining order to be relaxed and her plan to stay with the actor will certainly help in the case, adding "She's not the one who makes the decision, but her input will be considered."
Though he might not end up in jail, the "Two and a Half Men" star won't walk away without punishment. "He could be placed on probation; he could be ordered counseling, community service, alcohol treatment ... there are all kinds of things that will probably be imposed," Cron mentioned.

Martin Sheen will be charged with felony menacing as well as misdemeanor assault stemming from his Christmas Day incident in Aspen. Claiming to get the info from law enforcement sources, the site added that the criminal complaint will be filed either late Friday, February 5 or first thing Monday morning, February 8.
The TV actor is set to appear in court on Monday at 10.30 A.M. for an arraignment, but is not expected to enter a plea. At the hearing, the judge will also hear arguments from lawyers for both sides regarding the relaxing of the protective order prohibiting any contact between Charlie and his wife Brooke.
Charlie Sheen was arrested on Friday, December 25 after a call to 911 was made by Brooke Mueller. She, at the time, claimed that she was threatened with a knife by her husband during a heated argument at their house in Aspen, Colorado. Later in the evening, the 44-year-old was released from Pitkin County Jail after posting an $8,500 bond.
